Measures and recalls

West Virginia Amendment 1, the Citizenship Requirement to Vote in West Virginia Elections Amendment, is on the Nov 3 ballot

Amendment 1 (Senate Joint Resolution 9) was referred by the Legislature without opposition (House 97-0, Senate 34-0) during the 2026 regular session. Per the Legislature's official purpose statement, it provides that in all elections held in West Virginia only citizens of the United States who are citizens of the state are qualified to vote, by amending Article IV, Section 1 of the state constitution. A yes vote ratifies the amendment; a no vote rejects it and leaves the current wording.

A yes vote: Ratifies the amendment: Article IV, Section 1 would state that only citizens of the United States who are citizens of West Virginia are entitled to vote in all elections in the state.

A no vote: Rejects the amendment: Article IV, Section 1 keeps its current wording that citizens of the state are entitled to vote.
