What happened
Pinal County Attorney Brad Miller entered a 287(g) agreement with ICE and DHS, which he announced in December 2025, without approval from the Board of Supervisors. After outside counsel advised that board approval was required, the Board voted unanimously on January 30, 2026 to take civil action against him; Miller wrote that he had no intention of ending the agreement, arguing the authority was his as an elected official over a law-enforcement agency. On May 15, 2026, Maricopa County Superior Court Judge Michael Gordon ruled that no authority allows the county attorney to enter the contract and permanently blocked the agreement. Miller said he is strongly considering an appeal and that the ruling limits information-sharing with federal officials.
