A State Auditor's report made public April 22, 2026 on the North Dakota Racing Commission (July 2021 to June 2025) found, as reported by the North Dakota Monitor, that 3 of 13 sampled Promotion Fund grants totaling $25,500 had no applications on file, and that the commission spent about triple the amount of Promotion Fund money that state law allows for operating expenses in the 2025 budget year, with the overspend totaling more than $327,000 over the four-year audit period. Auditors also reported $63,675 in goods and services that did not follow state procurement rules. The commission's executive director said the awardees likely applied but the records could not be found and disputed how the limit was calculated; the commission said it is taking corrective steps.
