EPA proposes to approve Indiana partial coal-ash permit program covering 101 units; public comment open until Nov. 16, 2026

What happened
On Sept. 16, 2026 EPA proposed to approve a partial state coal combustion residuals (CCR, or coal ash) permit program for Indiana, based on an application the Indiana Department of Environmental Management submitted June 26, 2026 and supplemented Sept. 9, 2026. IDEM identified 101 CCR units in the state. The program is partial because some federal provisions that were vacated or remanded to EPA, including rules on suspending groundwater monitoring and groundwater protection standards for constituents without maximum contaminant levels, will continue to apply directly to each unit. No Indiana permits have been issued under the new rules, so none are part of the record under review. A hybrid in-person and online hearing is set for Nov. 12, 2026 and written comments are due Nov. 16, 2026 on docket EPA-HQ-OLEM-2026-4326.
