EPA proposes to approve Wisconsin coal-ash permit program for landfills only; public comment open until Nov. 10, 2026
Subject of this story
What happened
On Sept. 11, 2026 EPA proposed to approve a partial state coal combustion residuals (CCR, or coal ash) permit program for Wisconsin, based on an application the Wisconsin Department of Natural Resources submitted Feb. 24, 2026. The state identified 9 CCR units (6 landfills and 3 surface impoundments) at 6 facilities; the program covers landfills, and EPA says the three impoundments will continue to be regulated by EPA. Wisconsin rules reflect the federal CCR rule as amended through Aug. 28, 2020 and do not adopt the 2024 legacy rule or the Feb. 2026 deadline-extension changes; permits issued earlier under state rules are not part of the program under review. An online public hearing is set for Nov. 9, 2026 and written comments are due Nov. 10, 2026 on docket EPA-HQ-OLEM-2026-4324.
