What happened
On 30 September 2025 Senior US District Judge William Young, in AAUP v. Rubio, ruled that State Department and Department of Homeland Security actions targeting noncitizen students and faculty for pro-Palestinian speech violated the First Amendment; remedies were to be decided separately. On 11 June 2025 Judge Michael Farbiarz held the government could not deport or detain Mahmoud Khalil on the basis of Secretary Rubio's foreign policy determination. In January 2026 an immigration judge terminated removal proceedings against Tufts student Rumeysa Ozturk; DHS called the decision judicial activism.
