On Oct. 2, 2026, administrative hearing officer Macon Cowles issued a 27-page initial decision recommending a $57,647.16 fine against the Marx campaign for 210 violations of Colorado campaign finance law: 200 contributions over the $1,450 individual limit, totaling $82,713.32 from 110 donors, and 10 cash contributions over the $100 limit, totaling $1,045. The prohibited contributions were accepted between Nov. 23, 2025 and July 10, 2026. Cowles wrote that the scale of the violations was without precedent and intentional, and cited aggravating factors including that violations continued after the Elections Division notified the campaign. He also wrote that every prohibited contribution was disclosed in the campaign's own reports and that there was no allegation of hidden money, and he gave the campaign credit for disclosing and attempting to refund them. The recommended fine is higher than the amount the state requested. It is not final until the Secretary of State's office accepts it; the campaign and the Elections Division can challenge the decision, and the Deputy Secretary of State has the final say on penalties. The campaign had said it accepted the excess contributions unintentionally and attributed them to inexperience. After the decision, Marx said in a statement to Colorado Politics that the recommendation is wrong, that a fine of that size against a first-time campaign that reported every contribution is a political penalty, and that the campaign is appealing.
