Two Madison County parents have sued former Iowa DHHS Director Kelly Garcia, two DHHS child-protection workers and a Division of Criminal Investigation agent in U.S. District Court, according to Iowa Capital Dispatch. The suit alleges that after their four-month-old son was seriously injured at an unlicensed child-care provider in October 2024 and later died, officials barred them from his bedside, obtained their consent to temporarily remove their 3-year-old daughter, and kept her out of the home after a multidisciplinary team concluded the parents were not responsible. State attorneys say they do not comment on pending litigation. In February 2025 the child-care provider was charged with first-degree murder and pleaded not guilty; a trial is scheduled for Feb. 24, 2027. The suit's claims are allegations that a court has not decided.
