What happened
The House Select Committee to Investigate the January 6th Attack subpoenaed Rep. Andy Biggs on May 12, 2022. Its final report, released in December 2022, says Biggs did not appear for his scheduled deposition on May 26, 2022 and did not appear by the committee's June 11, 2022 deadline, after sending letters raising objections and invoking Speech or Debate immunity, and that the committee did not release him from the subpoena. The report says Biggs issued a press release the day the subpoena was issued calling it "illegitimate" and "pure political theater", and the day before his scheduled deposition sent a letter with objections and an invocation of Speech or Debate immunity. The committee referred Biggs, along with Reps. McCarthy, Jordan and Perry, to the House Ethics Committee for sanction, and said the referral was only for failure to comply with lawfully issued subpoenas. In a statement after the referral, as reported by CBS News, Biggs called the referral "eleventh-hour", said it showed the committee "never truly needed our testimony", said it was inappropriate to use the House Ethics Committee, and said the committee had defamed his name and character. The select committee ended with the 117th Congress. A search of the House Ethics Committee's website on Oct 5, 2026 shows no published statement or report naming Biggs, so no public outcome of the referral was found.
