Canada is still fighting the human rights tribunal orders to stop discriminating against First Nations children.
In January 2016 (2016 CHRT 2) the Canadian Human Rights Tribunal found Canada discriminated against First Nations children through its child and family services program and its narrow application of Jordan's Principle, and ordered it to stop. In its January 2025 reasons on a non-compliance motion (2025 CHRT 6), the Tribunal noted the backlog of Jordan's Principle requests was admitted by Canada; as of December 2024 about 140,000 requests were backlogged, including 25,000 marked urgent, and Ottawa sought judicial review of the backlog order on 20 December 2024.
