Colombia's Army ignored warning signs about a soldier who then raped a 13-year-old Indigenous girl, the country's top administrative court ruled, 17 years after the crime.
In a decision reported on 7 May 2026, Colombia's Council of State (Consejo de Estado) declared the National Army responsible for the 2009 rape of a 13-year-old Indigenous girl by a soldier, finding the crime was not an isolated act and reflected failures in the chain of command, which did not act to prevent the risk despite prior signs about the soldier's conduct. The criminal investigation took about five years to be reassigned to a human-rights unit and was closed in 2022 on the soldier's death without a conviction.
