Florida illegally pushed medically fragile children into nursing homes by shorting the at-home nursing care they qualified for, a federal appeals court affirmed.

In a case the U.S. Justice Department brought in 2013 under Title II of the Americans with Disabilities Act, a federal district court found after a two-week trial (2023) that Florida's Medicaid program unlawfully institutionalized medically complex children or placed them at serious risk of it.
